Types of Law-法律的類型

Case law:

Case law is further divided into two types: common law and equity.

Common law: Law created by judges through the application of the principle of judicial precedent. Common law was the earliest element of the English legal system, and was developed after the Norman Conquest in 1066. Common law drew on customs, and remedies under common law are monetary known as damages.

Common law: Developed two or three hundred years later than common law, to introduce fairness/justice/equity into the legal system. Equity law held fairness as its guiding principle. Equitable remedies may only be awarded at the discretion of the court (such as specific performance in contract law).

Today, common law and equity law are applied in the same courts.
